General Terms and Conditions of Sale

Preamble:
The Agency for the Development of Heritage and Cultural Promotion (AMVPPC) is a public institution of a non-administrative character, endowed with its legal personality and financial autonomy, subject to trade legislation, and placed under the supervision of the Ministry of Culture and Heritage Preservation.    

The website www.tunisiepatrimoine.tn is the official website of the AMVPPC.

 It contains an e-commerce section. The e-Shop offers the possibility to sell online catalogs to users browsing the site.   

 Subject-Matter:
The present conditions set the terms of sale between the AMVPPC and the Customer, namely the order, delivery, and payment.

These conditions are exclusively reserved for non-trading natural persons.  

1.  Clause 1: Scope of Applicability of the General Terms of Sale:

The present General Terms and Conditions of Sale apply to all orders submitted on the site. At the time of the order, the customer should explicitly acknowledge having read and accepted these terms and conditions without reservation. The General Terms and Conditions of Sale are subject to change at any time. For this reason, the General Terms and Conditions of Sale that apply to the customer are the ones in force when placing the order.

2. Clause 2 : Responsibility
The AMVPPC declines all responsibility concerning possible interruptions or bugs in the website.  The Agency for the Development of Heritage and Cultural Promotion does not provide any guarantee regarding either all or parts of the website, specifically relating to any direct or indirect damage arising from the use of the website or the purchase of products.  The AMVPPC pledges to describe accurately the products sold on the website.  

 The site may reference links to other external sources, given that the Agency for the Development of Heritage and Cultural Promotion cannot have control over these external sources.       

3.  Clause 3 : The Order
The orders are placed exclusively on the Internet via our website's address.

Any order implies acceptance of the prices and descriptions of the products available for sale.  Our products and prices are valid as long as they are visible on the website while stocks last.      

In the case of products on special offers, the customer should be aware that these products are on special offer while stocks last and that these promotions may be of limited duration. If, however, a product is temporarily unavailable after you have placed your order, we will inform you of this by phone.

In the case of an incorrect shipping address, payment default, or any other issue with the user's account, the AMVPPC reserves the right to suspend the processing of the customer order until the issue is settled or to cancel the customer order and reimburse the customer for any produced breaks in supply.   

The AMVPPC maintains the right to cancel or refuse any order from any customer with whom there is a dispute over the payment of a previous order.      

4.  Article 4: The Tariffs and Payment Conditions
The sale prices of the products on the site are indicated in TND. They apply to the existing products at the moment the order is registered by the customer. The AMVPPC reserves the right to adjust its prices at any time.

The prices indicated on the website include the value added tax (VAT) applicable on the day of the order. Any change in the rate applicable will be reflected in the price of the products available on the website.

The prices do not include the charges for processing the order (shipping, packaging, and handling fees charged in addition to the cost of the products purchased.)

At the AMVPPC, payment is made with a credit card.

Default of Payment: the AMVPPC reserves the right to refuse to undertake a delivery or to fulfill an order from a client who would not have fully or partially settled a previous order or with whom a dispute would be still under administration.    

Case of Force Majeure: The AMVPPC reserves the right to cancel the order of a customer if it judges that it was not under the right conditions to fulfill this order or in the case of erroneous price.

5. Clause 5: Order Preparation, Shipping, and Delivery
Our usual preparation time is between 24 and 48 hours.

The deliveries are ensured by the Tunisian Post.

The tariffs of the order's preparation and delivery will be notified before the validation of your order; they are subject to change at any moment.

6. Clause 6: Conformity of Products and Complaints
The transfer of ownership shall be deemed effective at the time of shipment of the products by the AMVPPC.

The ordered items are shipped to the delivery address mentioned in the purchase order. 

The information stated by the purchaser while placing the order is accountable to him/her: If the purchaser makes an error in the wording of the details of the recipient, the AMVPPC could not be held responsible for failure to deliver the order.    

If, after delivery, the customer notices that the products delivered do not correspond to his order, have defects, or are damaged, he or she is required to make a claim within five working days following the date of delivery indicated by the carrier. We will not handle any claims made after this period, and our responsibility will be discharged.  

  7. Clause 7: Withdrawal and Refunding  
Right of Withdrawal: The customer has the right to return delivered products to the AMVPPC within a period of 7 days, under the conditions set out in detail below.

When the seven-day period expires on a Saturday, Sunday, an official holiday, or a non-working day, the withdrawal period is extended until the next working day.

Products must be returned to the AMVPPC in their original condition (packaging, instructions, accessories...), properly sealed, and in a perfect state for resale.  In case return following non-compliance with the product caused by our services, the return shipping costs are at the charge of the AMVPPC.       

The parcels returned in cash on delivery form will be systematically rejected. 

The refund of an order is done upon the request of the customer within 30 days.

However, no return of any order will be accepted if the customer has not contacted Customer Service beforehand.

Products damaged by the customer are neither refunded nor exchanged.            

8. Clause 8: Intellectual Property
The documents and elements (texts, images, video, audio) included in the AMVPPC website and their layout are the sole and exclusive property of the AMVPPC. 

The AMVPPC does not grant any license nor any right other than that of browsing the website.    

The copying of all documents published on the site is authorized for the exclusive purpose of providing information for personal and private use. Any other use is strictly prohibited.

The AMVPPC reserves the right to pursue legal remedies and seek damages in the case of any infringement of its intellectual property rights.  

9. Clause 9 :  Data Protection 
The AMVPPC is committed to protecting the confidentiality of the data provided online by the customer to www.tunisiepatrimoine.tn to ensure the proper management of orders, deliveries, invoices, and the use of other services. 

The customer has the right to access, modify, rectify and delete data about him/her. To exercise this right, the customer can send an e-mail to contact@tunisiepatrimoine.tn

If the customer does not longer wish to receive messages such as newsletters and promotional emails, he/she can notify the AMVPPC at any time by e-mail to contact@tunisiepatrimoine.tn

www.tunisiepatrimoine.tn is likely to use cookies files placed on the computer of its website visitors. A cookie file stores information about the navigation of the browser's computer on the AMVPPC website. As a result of the use of cookies, the visitor will no longer need to fill in some of the previously-requested information on a subsequent visit.   

10. Article 10 : Force Majeure
The AMVPPC will not be held responsible for the non-execution of the contract concluded due to force majeure. 

11.   Article 11 : Laws Applicable to Disputes
This document is subject to Tunisian law.

In case of dispute, the exclusive jurisdiction is assigned to the Tunisian tribunals.
